TERMS & CONDITIONS (SUMMARY)

The following is a guide to how I work at Weddings by Mark. A full, detailed contract will be provided for you to sign upon booking. In the event of any discrepancy, the signed contract takes precedence.

1. BOOKING & PAYMENTS
To secure your date, a non-refundable retainer is required. This secures Weddings By Mark for your specific date, meaning we will decline any other enquiries for that day.
– The Retainer: This fee is deducted from your final balance. It is non-refundable in the event of cancellation.
– Final Balance: The remaining balance is due 45 Days prior to the wedding date.

2. CANCELLATIONS & DATE CHANGES
– Cancellation: If you need to cancel your booking, the retainer and any fees already paid cannot be refunded. If the cancellation occurs within 8 weeks of the wedding, the full balance may become due.
– Date Changes: If you need to change the date, we will do our best to accommodate you (subject to availability). An admin fee may apply, and written consent is required.

3. COPYRIGHT & USAGE
– Your Rights: While Mark Powell retains the copyright to all images, you (the client) are assigned full Usage and Print Rights for personal use. You are free to print, copy, and share your wedding photos with friends and family.
– Social Media: We love it when you share your photos! However, we kindly ask that you do not apply filters (like Instagram filters) or alter the editing style, to preserve the integrity of the professional work.
– Promotion: Weddings By Mark reserves the right to use images for promotional purposes (website, social media, brochures) unless otherwise agreed.

4. THE WEDDING DAY
– Exclusivity: To ensure you get the best results, it is agreed that Mark Powell/Weddings By Mark shall be the sole professional stills photographer on the day.
– Guest Photos: We actively encourage guests to take photos! However, we may ask guests to refrain if they are obstructing the professional photography or affecting the lighting.
– Meals: For full-day coverage, a meal/lunch for the photographer is greatly appreciated, as it is difficult to leave the venue to find food without missing key moments.

5. ARTISTIC DISCRETION & EDITING
– Style: We will edit every photo delivered. We endeavor to capture all key moments, but due to the fluid nature of weddings, we cannot guarantee specific shots if logistical restrictions or weather issues arise.
– Editing: Images are edited in our signature style. Please note that colors can vary slightly depending on the lighting conditions of the day and the screen/monitor you view them on.

6. DELIVERY & STORAGE
– Fast Turnaround: We pride ourselves on speed. Your full set of edited photographs will be available to view online typically within 3 -5 working days (usually 3 days) after the event.
– Gallery Duration: Your online gallery will be live for 3 months.
– Backups: We keep your digital files for 12 months from the wedding date. We strongly advise clients to download and create their own backups immediately upon receipt.

7. PRIVACY POLICY
Weddings By Mark respects your privacy. We store your data on a private internal database and will never share it with outside companies or individuals.
